CONDITIONS ON USE

These General Conditions of Contracting regulate the use of the maask.eu websiteMAASK property, with address in C/ Musician Azorín Torregrosa 12, 30510, Yecla, Murcia e-mailinfo@maask.euand phone868 043 813 with CIF B-73817280, registered in the Mercantile Registry with number MU83485, Folio 1, Tomo 3000, Section 8, inscription 1a.

All orders made inmaask.euit necessarily implies, as an essential, decisive and essential condition, the acceptance by the Customer of the General Conditions of Use in force on the day on which the relevant order is made. Furthermore, the Customer acknowledges that acceptance of these conditions will involve the application of these conditions to the order to which they refer, as well as to any subsequent order, except in cases where new conditions are brought to their knowledge.

USERS

In order to acquire any of the products shown in MAASK.EU, you must be legally trained in accordance with the Spanish Legal Order.

STANDARD PRODUCT COMPANY (COLECTION)

Standard or collection products are those you can buy in MAASK without requesting individualization of them.

By purchasing standard products, clicking on the “buy” button, you make a binding purchase offer. Before sending the binding order, you can review the order data at all times (markets, quantity, price, shipping and payment modality) and, if necessary, modify it. The order process can be cancelled at all times leaving it.

Confirmation of the order is made with an automatic email immediately after the order is sent, not assuming that the offer is accepted by MAASK.

If there were any misstatements in the prices by computer errorMAASK reserves the right to cancel and refund that order.

CUSTOM PRODUCT COMPANY (PERSONALIZED)

Custom or custom products are those that have been individualized by the customer, so that they are made according to the concept of the customer, e.g. The design, colors or incorporation of logos.MAASK will e-mail you the rates and conditions of customization of the product.

You have the control design, budget and delivery conditions for your verification, and you can send toMAASK your written or email confirmation within two weeks of entry. With the receipt of the confirmation by you, the contract is concluded. You will then receive a brief confirmation ofMAASK by email.

The minimum amount to place a first order of custom products is 25 units.


PRICES

For customers within the European Union, the prices indicated are final prices. They contain the relevant taxes, in particular VAT and all other components of the price. The shipping costs shall be detailed separately in the invoice.

For customers outside the EU, all the prices indicated are understood as net prices. The determining criterion is the delivery address. Where, in accordance with the laws of the country of receipt, value added tax is applied, the value added tax shall be paid additionally when the goods are received. Import duties may also be applied, which must be paid additionally by the customer when he receives the goods. The abovementioned amounts shall be charged or by the customs authorities or the transport undertaking responsible for the consignment.

The price also includes transport and packaging costs. The customer shall assume a total amount by postage which may vary according to the value of the order and the place to which it must be sent, taking into account a possible delivery fee in a remote area.

PAYMENT FORMS

Payment shall be made through any of the following means:

  • Purchases with credit or debit card;the user must provide the name of the card holder, number, expiry date and CVV. All information will be processed through the bank's VAT.
  • Payment with PayPal;PayPal allows consumers with e-mail to send payments on the Internet safely, comfortablely and profitably. The PayPal network is based on the existing financial infrastructure of bank accounts and credit cards to create a global real-time payment solution.

TARACELS

Possible tariffs, taxes and other charges (for international shipments and those to be paid to the Canary Islands with a value of more than € 150) are not included in the price of the item or in the shipping costs. These charges are the responsibility of the buyer*.

*Including purchases from the United Kingdom from 31 October 2019 (Brexit)

If the buyer refuses to pay these charges and requests the order back, Maask will reimburse its value minus the shipping cost and subsequent return.

RESERVE OF PROPERTIES

The goods will be owned byMAASK until the fulfilment of the payment requirements of the shipping contract (market in reserve) with respect toMAASK .

The customer is obliged to treat the goods carefully until the change of owner occurs and this becomes his or her property.

MAASK reserves the right of ownership and copyright for illustrations, designs, drawings, calculations and other documents delivered to the customer. This also applies to written documents that have not been designated as confidential. Before giving access to these documents to third parties, the customer will need the express and written consent ofMAASK.

RIGHT OF DISISTIMIENT

The user may revoke the purchase of standard products within 14 calendar days without justification. The period of withdrawal shall expire at 14 calendar days from the time the customer or a third party by the customer indicated, other than the carrier, acquired the material possession of the goods.

In order to exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract through an unequivocal statement. You also have the option to fill in and send out the dismissal form model published in Changes and Returns. If you resort to that option, we will notify you without delay, on a lasting stand, of receiving such desistment.

If the cause of the refund is that the returned article is defective or does not correspond to the request, MAASK will bear the costs of the return and new shipment.

If the reason for the refund is that the order does not satisfy you, we will reimburse you the amount, including delivery costs (except delivery costs if you have chosen an option other than ordinary delivery, in this case only the expenses allocated by the website for ordinary delivery will be returned) without any undue delay.

Return shall be made no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.

You will have to take on the direct cost of returning the goods.

Reimbursement shall be made using the same means of payment as used in the initial transaction, unless you have expressly stated otherwise, and provided that it does not entail additional costs.

MAASK reserves the right to retain reimbursement until the property has been received and the revised status of the property.

In custom products, due to the specific conditions of the product and the total customisation thereof, only products which are defective may be returned.


GARANTY

All our products have two years of legal guarantee, which MAASK is responsible for as a seller of the product, in the legally established terms.

Deficiencies caused by negligence, stroke, use or mishandling, unfit voltage, or wear materials are not included because of their normal use.

In textile printing, slight variations of pitch, both in color tests, as well as in subsequent delivery are always possible and inevitable. MAASK maximizes its effort to reproduce the colors of the catalog (online or in brochures) and its website as realistic as possible. In particular, the colors that can be seen on the MAASK website, depend on the customer screen settings, so MAASK cannot guarantee a proper comparison of colors. Therefore, the shipment of the MAASK color palette in fabric is highly recommended.

In cases justifying the use of the security, reparation, replacement of the article, rebate or refund shall be chosen in the legally established terms.

RESPONSIBILITY

MAASK excludes its liability to the customer for minor negligence, provided that it does not affect essential contractual obligations, damages resulting from an injury to life, body or health or guarantees arising under the Defective Product Liability Act. The same applies to infringements by MAASK law enforcement officers or representatives. A key contractual obligation is given in obligations whose compliance allows for the proper execution of the contract or in which the customer can and must rely on its compliance.

MAASK's liability to an employer for minor negligence of a essential contractual obligation is limited to predictable and typical damages.

Copyright/ third party rights, release of responsibility, inadmissible designs

If the customer delivers a motive of his own or exerts any other influence on the product (e.g. text customization), the customer assures MAASK that such design, text and motive are exempt from third party rights. The customer shall be solely responsible for any violation of copyright and samples, rights to personality protection or rights to the name. The customer also ensures that it does not infringe on third party rights by individualizing the product. Primarily, in the case of using legally protected logos, images, slogans, typographys or designs, the customer is responsible for obtaining a written legal owner's authorization and submitting it to MAASK without being requested.

The customer shall release MAASK from all the requirements and rights enforced for the violation of such third-party rights provided that the customer is responsible for the breach of duty. The customer will take over all the expenses of the defense and other damages that are caused to MAASK.

Designs containing images or inscriptions or other wishes of the client affecting the privacy of third-party rights, containing pornography, intended for the distribution of prohibited propaganda or inciting to commit or participate in crimes, shall not be produced by MAASK.

In particular, clubs should be aware of the possible policies and guidelines of their leagues and associations as to their apparels. MAASK does not assume any obligation or responsibility for possible violations.

Labelling of products, self-promotion and personal rights All products supplied by MAASK generally contain:

  • One or more MAASK logos and/or texts visiblely.
  • One or more MAASK labels sewn visiblely, with a MAASK logo and/or text.
  • One or more MAASK labels sewn in the inside, with a MAASK logo and/or text.
  • A washing label with logo and/or MAASK text.

Additionally, other materials from the textile product may carry the MAASK logo.

MAASK has the right to present its products on its website (on-line shop), in its catalogues (and on-line catalogues) as well as in other forms of presentation of products, advertisements, etc. regardless of form (electronic or written), and in exhibitions.

MAASK can mention the customer in different media as a reference. This also includes the mention and use of any of the protected names or logos. MAASK will not be obliged to mention the customer. The customer may restrict or prohibit the mention of MAASK.

In the case of production error or overproduction, MAASK reserves the right to use such products as samples available to other customers or to be used in internal controls.


    DEVOLUTIONS

    No returns of masks are allowed unless the material has any origin problem.


    DEFECT PRODUCTS

    We control the quality of each productHowever, in minimal cases, there may be some manufacturing defect. If you think your product has a manufacturing defect, please contact us at shop@maask.eu

    Given the health and protection characteristics of these masks, products damaged as a result of their use shall not be considered defective.

    MAASK shall be charged with shipping costs provided that the collection is scheduled byMAASK, and in NO case if the customer has chosen a different form of shipment. In cases where shipping costs are borne by the customer,MAASK provide a label with the address to which you must send the package, by your own means. If you need us to help you find a transport agency, you can apply for it.

    REQUIREMENT CANCELATION PROCESS

    You may request cancellation of your order provided that this has not been processed. That is, even if payment has been made, the order has not left our facility. To process your cancellation, please send us an email to shop@maask.eu with your personal data and the order ID data (order number and personal data) or calling the phone +34868 043 813 if you have any doubts.



    CONDITIONS OF DESIGN (SERVICES CUSTOMS)

    1. The designs made by MAASK are the sole property of the latter, thus MAASK can make use of such designs for promotional and informational purposes.
    2. It declares the customer under its sole responsibility, which has the relevant authorizations for the use of both the logos and any other graphs that have been made available to MAASK to include in the design.
    3. As for designs that have not been fully made by MAASK and have been forwarded by the customer, confirmation of the order by the customer authorizes MAASK to use it for merely promotional and informative purposes.

    COMMUNICATIONS

    APPLICABLE AND FORUM LAW

    The present purchase system is subject to the legislation in force in Spain (Civil Code, Commerce Code, Law 7/1996 of 15 January on the management of retail trade, Law 7/1998 of the General Conditions of Contracting, Law 26/1984, General for the Defence of Consumers and Users, Royal Decree 1906/1999 of 17 December on telephone and electronic contracting under conditions General and Law 34/2002, on Information Society Services and Electronic Commerce). Under Law 34/2002 of 11 July, the contract shall be presumed to be concluded at the address of the seller (Spain). If there are disagreements which may arise as a result of the present contractual relationship and cannot be resolved in a friendly manner, they shall be submitted to the Tribunals which are considered competent in each case.
